Terms of Service

The rules governing your use of MezbanPOS restaurant POS software and website.

Please read these Terms of Service (“Terms”) carefully before using the MezbanPOS website at mezbanpos.com (“Website”) or the MezbanPOS desktop application (“Software”), operated by MezbanPOS (“we,” “us,” “our”), a company based in Pakistan. By accessing the Website or downloading/using the Software, you agree to be bound by these Terms.

1. Definitions

  • “Software” refers to the MezbanPOS desktop point-of-sale application available for Windows, macOS, and Linux.
  • “Service” refers to the Software, Website, and any related support, updates, or documentation we provide.
  • “Subscriber” refers to any individual or business entity that has purchased a subscription to use the Software.
  • “Free Trial” refers to the 30-day evaluation period during which you may use the full Software at no cost.
  • “Location” refers to a single physical restaurant, cafe, or food service establishment where the Software is deployed.

2. License Grant

Subject to these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software at one physical business location per subscription. You may install the Software on unlimited devices within that single location (e.g., multiple POS terminals, kitchen displays, and order screens connected over your local network).

3. Free Trial

We offer a 30-day free trial with full access to all features. No credit card or payment information is required to start the trial. At the end of the 30-day trial period, you must purchase a subscription to continue using the Software. We reserve the right to modify or discontinue the free trial offer at any time without prior notice.

4. Subscription & Payment

  • The Software is offered on a monthly subscription basis at Rs 4,000 PKR per month per location.
  • Payment can be made via bank transfer, JazzCash, Easypaisa, or any other payment method we make available. You agree to provide accurate and complete billing information.
  • Subscriptions automatically renew each month unless cancelled before the next billing date.
  • All fees are quoted in Pakistani Rupees (PKR). You are responsible for any applicable taxes (including GST/Sales Tax) in your jurisdiction.
  • We reserve the right to change pricing with 30 days’ advance notice. Existing subscribers will be notified via email and/or WhatsApp before any price change takes effect.
  • There are no setup fees, no per-terminal charges, and no transaction fees.

5. Cancellation & Refunds

  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will not be charged again.
  • There are no cancellation fees and no long-term contracts. MezbanPOS is strictly month-to-month.
  • If you are unsatisfied within the first 30 days of a paid subscription, contact us at hello@mezbanpos.com for a full refund — no questions asked.
  • Refunds are not available after the 30-day window, except where required by applicable Pakistani law.
  • Refunds will be processed via the same payment method used for the original transaction within 7–10 business days.

6. Permitted Use

You agree to use the Software only for its intended purpose — managing point-of-sale operations at a legitimate food service business (restaurants, cafes, pizza shops, bakeries, BBQ joints, biryani houses, dhabas, takeaway outlets, and similar establishments). You agree not to:

  • Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Software.
  • Copy, redistribute, sublicense, rent, or lease the Software to any third party.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
  • Use the Software for any unlawful purpose or in violation of any applicable laws of Pakistan.
  • Attempt to circumvent the license management, trial period restrictions, or subscription verification.
  • Use automated tools (bots, scrapers) to interact with our Website in a way that degrades service for others.
  • Share your subscription credentials or license key with individuals or businesses outside your licensed location.

7. Your Data

MezbanPOS is an offline-first application. All business data — including orders, menu items, customer information, reports, and financial records — is stored locally on your machine in a SQLite database and is never transmitted to our servers. You are solely responsible for:

  • Backing up your data regularly (the Software includes built-in backup tools that trigger on shift close).
  • Securing your devices, local network, and physical access to your POS machines.
  • Complying with all applicable data protection and privacy laws in Pakistan regarding your customers’ personal data.
  • Maintaining the integrity of your data during power outages, hardware failures, or device replacements.

We have no access to, and assume no liability for, your business data. If you uninstall the Software, your local data remains on your machine — we cannot and do not delete it remotely.

8. Intellectual Property

The Software, Website, documentation, logos, brand name “MezbanPOS,” and all related materials are owned by MezbanPOS and are protected by copyright and intellectual property laws of Pakistan and international treaties. Your subscription grants you a license to use the Software — it does not transfer ownership of any intellectual property.

9. Software Updates

We may release updates, patches, bug fixes, and new features from time to time. All updates are included in your subscription at no additional cost. An internet connection is required only to download updates. We are not obligated to provide any specific features, updates, or a particular release schedule. Updates will never affect your locally stored data.

10. Support

Active subscribers receive support through the following channels:

We aim to respond within 1–2 business days. Support is available in English and Urdu. We do not guarantee resolution of all issues. On-site support and dedicated phone lines may be introduced in the future.

11. Service Availability

Since MezbanPOS runs offline on your local machine, the Software does not depend on our servers to function. Our Website and API (used only for downloads, updates, and subscription management) are provided on an “as available” basis. We will make reasonable efforts to maintain uptime but do not guarantee uninterrupted access to the Website.

12. Disclaimer of Warranties

The Software and Website are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose.
  • Uninterrupted, error-free, or secure operation.
  • Accuracy or reliability of any results, reports, or calculations produced by the Software.
  • Compatibility with all hardware, printers, or network configurations.

We do not warrant that the Software will meet your specific requirements or that any defects will be corrected within a specific timeframe.

13. Limitation of Liability

To the maximum extent permitted by the laws of Pakistan, MezbanPOS and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business, or goodwill, arising from:

  • Your use of (or inability to use) the Software or Website.
  • Data loss or corruption on your local machine, including from power failures, hardware faults, or accidental deletion.
  • Unauthorized access to your devices or local network.
  • Any third-party actions, products, or services.
  • Inaccurate tax calculations, receipt totals, or report figures (it is your responsibility to verify all financial data).

Our total aggregate liability to you for any claims arising from these Terms shall not exceed the total amount you have paid us in the 12 months preceding the claim.

14. Termination

We may suspend or terminate your license if you violate these Terms. Upon termination:

  • Your license to use the Software is immediately revoked.
  • You must uninstall and delete all copies of the Software from your devices.
  • Your locally stored data remains yours — we cannot and do not delete it.
  • No refund is owed for the current billing period if termination is due to a Terms violation.

You may also terminate your subscription at any time by cancelling through the methods described in Section 5.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Pakistan. Both parties agree to attempt to resolve disputes amicably before pursuing legal action.

16. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MezbanPOS regarding your use of the Software and Website. They supersede any prior agreements or understandings, whether written or oral.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be communicated via email and/or WhatsApp to active subscribers at least 15 days before they take effect. Continued use of the Software after the updated Terms take effect constitutes your acceptance of the changes.
